Green card through a job

Many immigrants become permanent residents by job offers. In some cases, a certification is required by the US department of labor to show that there are not sufficient US workers who are able, qualified, willing and available in the geographic area where the immigrant is to be employed and also that no American worker is to be displaced by providing employment to the immigrant. Other categories include employment to immigrants of extraordinary ability and skill, whose employment serves the US national interest. Special categories of self-application of green card are entitled to individuals of extraordinary caliber.

Green card through a job offer means the employer should file a petition for the employee. The employer has to get a certificate of authentication from the Labor department and is required to fill up the Form I-140, Petition for Alien worker.

The application process is divided into two categories. First, for the employee living inside the US; and, secondly when the employee is outside the US.

When living inside the US: An immigrant worker can become a permanent resident through adjustment of status when living in America. The first requisite is filling up and applying the Form I-140, immigrant petition for Alien worker. After the form I-140 is approved and you have got a visa number, you have to apply on Form I-485, which is the application to register permanent residence or adjustment of status to become a permanent resident. The supporting documents required to be submitted with the Form I-485 are listed below.

• Inspection evidence, parole or admission into the United States or the Form I 94 (arrival –departure record)
• If you already have an approved immigrant petition from the USCIS, you are required to submit a copy of the approval notice
• The job offer letter received from your employer
• Two color photographs taken within 30 days
• The Biographic Data sheet or the Form G-325 A (for green card applicants between age 14-79)
• Form I-693 or Medical Examination report
• Form I 864 or the affidavit of support to be completed by the sponsor/employer (If you or your relative own a percentage of the employer company, then this does not apply)
• Any other strong evidence that establishes your eligibility as a green card holder

If living outside the US

When you are living outside the US, then you can gain a permanent residence through consular processing.
